Council Prohibits Unlawful Loitering At Lockemy Courtyard

The Dillon City Council passed the second and final reading of an ordinance prohibiting unlawful loitering at Lockemy Courtyard.  The ordinance reads as follows:
AN ORDINANCE AMEDING TITLE 9 (OFFENSE) OF THE CITY OF DILLON CODE OF ORDINANCES IN ORDER TO ADD CHAPTER 6 (UNLAWFUL LOITERING), SECTION 96-1 THROUGH 9-6-4 FOR THE PURPOSE OF REGULATING AND PROHIBITING LOITERING IN CONNECTION WITH UNLAWFUL ACTIVITIES ON THE PREMISES OF LOCKEMY’S COURTYARD WITHIN THE DILLON COMMERCIAL OVERLAY DISTRICT INSIDE THE JURISDICTION OF THE CITY LIMITS OF DILLON.
WHEREAS, the City of Dillon has received several complaints concerning unlawful loitering on the premises of Lockem’s Courtyard within the Dillon Commercial Overlay District inside the jurisdiction of the city limits of Dillon with no apparent purpose other than to establish control over subject premises, to intimidate others from entering the subject premises and to conceal illegal activities thereon such as, but not limited to prostitution, unlawfully use or possess an unlawful drug;or unlawfully use or possess alcoholic beverages, beer or wine.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Dillon, South Carolina that Title 9 (Offences) of the City of Dillon Code of Ordinances is hereby amended to include the addition of Chapter 6 (Unlawful Loitering, Lockemy’s Coutyard), Section 9-6-1 through 9-6-4 so that the provisions thereof shall read as follows:
Section I.     Section 96-1   )Unlawful Loitering, Lockemy’s Courtyard)
It shall be unlawful for any person to loiter on the premises of Lockemy’s Courtyard within the Dillon Commercial Historic Overlay District inside the jurisdiction of the city limits of Dillon with no apparent purpose other than to intimidate others from entering the subject premises, to establish control over subject premises, and to conceal illegal activities thereon in such a manner as to:
(1)  Create or cause to be created any disturbance or annoyance to the comfort and repose of any person;
(2)  Create or cause to be created a danger of a breach of the peace;
(3)  Obstruct or hinder the free passage of vehicles or pedestrians;
(4)  Obstruct or interfere with any person lawfully on the premises of Lockemy’s Courtyard;
(5)  Engage in begging;
(6)  Engage in gambling;
(7)  Engage in prostitution;
(8)  Solicit or engage in any businesses, trade or commercial transaction unless specifically authorized or licenses to do so;
(9)  Unlawfully use or possess an unlawful drug; or
(10) Unlawfully use or possess alcoholic beverages, beer, or wine;
