DILLON COUNTY COUNCIL
REGULAR MEETING
OCTOBER 28, 2015
4:00 PM
The Dillon County Council held a regular meeting on October 28, 2015 at 4:00 pm in the County Council Chambers, 109 S 3rd Ave, Dillon SC.  Present were: Randy Goings, T.F. Finklea, Harold Moody, Bobby Moody, Archie Scott, Robbie Coward and Stevie Grice.  Also present were: Clay Young (County Administrator), Richard Gaddy (Finance Director), Alan Berry (County Attorney), and Jamie Sue Stephens (Clerk to Council). Not present was Betsy Finklea (The Dillon Herald).

Chairman T.F. Finklea presided over the meeting.

The County Council led the Pledge of Allegiance.
 
INVOCATION
Invocation was given by Randy Goings.                

APPROVAL OF AGENDA
Robbie Coward motioned to add to agenda to hire an engineer at Bingham, Station #6.  Archie Scott seconded and all were in favor (New Business 6E). Archie Scott motioned to add to agenda, to adopt a policy to allow tax payers to come up with a plan that would be optional to pay partial payments to the end of the year. Discussion was held concerning issues related to property tax. (Dillon County collects taxes for the schools and municipalities).  Motion failed.  T.F. Finklea appointed Robbie Coward, Harold Moody, Archie Scott and Richard Schafer to be on a committee to look into a payment plan for property tax and to bring recommendation back to Council.
Robbie Coward motioned to approve agenda as amended.  Archie Scott seconded and all were in favor.
 
APPROVAL OF MINUTES – 09/23/15
Robbie Coward motioned to approve the minutes.  Archie Scott seconded and all were in favor.  
Randy Goings discussed issues from the last meeting and his disagreement with Robbie Coward.
 
PUBLIC HEARING
AN ORDINANCE AUTHORIZING THE ISSUANCE AND SALE OF NOT EXCEEDING $1,400,000 GENERAL OBLIGATION BONDS, SERIES 2016, OF DILLON COUNTY, SOUTH CAROLINA; FIXING THE FORM AND DETAILS OF THE BONDS; PROVIDING FOR THE

AN ORDINANCE AUTHORIZING DILLON COUNTY, SOUTH CAROLINA, TO EXECUTE AND DELIVER AN EQUIPMENT LEASE PURCHASE AGREEMENT, 2015, IN THE AMOUNT OF NOT EXCEEDING $750,000 BETWEEN THE COUNTY AND THE LESSOR THEREOF TO DEFRAY THE COST OF ACQUIRING CERTAIN EQUIPMENT; AND OTHER MATTERS
RELATING THERETO
There was no public comment.  (The public hearing was properly noticed in The Dillon Herald’s October 8, 2015 edition.)
 
NEW BUSINESS
2015-2016 NESA ECONOMIC DEVELOPMENT GRANT PROGRAM
Tonny McNeil told Council that this is a strategic five year grant for retail which will include mixed use Industrial property and Commercial Property; Existing Building Sites; Downtown Development; Residential mixed use, Residential and Commercial Property.  Tonny is requesting $25,000 from the County and NESA will match $25,000. Archie Scott motioned to approve $25,000 matching grant. Robbie Coward seconded and all were in favor.
RECREATION REQUESTS
Archie Scott motioned to approve the following: $150.00 payable to New Saint Mark Missionary Baptist Church for Halloween bags for the children in the church and community – $75.00 from Archie Scott’s recreation, $75.00 from Randy Goings recreation; $250.00 payable Perdue Foods LLC, Charity Golf Tournament for Pee Dee Coalition Against Domestic And Sexual Assault on November 13th, 2015 at the City of Dillon Municipal Golf Course – $50.00 from Bobby Moody’s recreation, $50.00 from Harold Moody’s recreation, $50.00 from Randy Goings recreation, $50.00 from T.F. Finklea’s recreation, $25.00 from Archie Scott’s recreation, $25.00 from Stevie Grice recreation; $45.00 payable to Latta Revitalization Committee for Tour of Homes from T.F. Finklea’s recreation; $50.00 payable to Euclid Chapter #24 Order of the Eastern Star and the Rite of Adoption Jurisdiction of South Carolina from Randy Goings recreation. Robbie Coward seconded and all were in favor.
Harold Moody motioned to give $1000.00 from the general fund to Humane Society of Dillon County for Chili Cook-Off on Saturday, November 21st, 2015 at the Dillon Wellness Center.  Robbie Coward seconded and all were in favor.
 
BOILER REPLACEMENT – DETENTION CENTER
Mr. Gaddy told Council that the boiler that heats the kitchen is leaking and needs to be replaced.  He explained that he tried doing sealed bids, that Danny McKenzie looked at the boiler and he was not interested in bidding on it.  Daikin has not given a bid.  One bid was received from Miller Plumbing and Electric in the amount of $33,388.00.  Robbie Coward motioned to accept the bid of $33,388.00 from Miller Plumbing and Electric.  Archie Scott seconded and all were in favor.
 
6” DISCHARGE WATER PUMP – ROADS & BRIDGES
Mr. Young told Council that he would like to delay and defer to Public Works and bring back to Council.
 
 
Harold Moody motioned to table 6” Discharge Water Pump.  Randy Goings seconded and all were in favor.
ENGINEER AT BINGHAM FIRE DEPARTMENT – STATION #6
Robbie Coward motioned to hire one engineer at Bingham Fire Department.  Archie Scott seconded.  Voting for the motion were Stevie Grice, Robbie Coward, Archie Scott and Bobby Moody.  Opposed to motion were Harold Moody, TF Finklea, and Randy Goings. Motion carried.
 
OLD BUSINESS
SECOND LEASE MODIFICATION AND HOLDOVER AGREEMENT BETWEEN HARBOR FREIGHT TOOLS USA, INC. AND DILLON COUNTY, SC
Mr. Young told Council that Harbor Freight would like to continue the lease for October, November and December in the amount of $14,420.00 per month and then it would be month to month.   Robbie Coward motioned to modify the lease with Harbor Freight.  Randy Goings seconded and all were in favor.
FINANCE REPORT
Mr. Gaddy told Council that currently we had a negative 877,270.52 more expenses than revenue.  This negative trend will continue until December when taxes come in.

Bobby Moody motioned to have third reading.  Harold Moody seconded.  Voting for the motion were Harold Moody, Stevie Grice, TF Finklea, Randy Goings, and Bobby Moody.  Opposed to motion was Robbie Coward.  No action to motion was Archie Scott.  Motion carried.

Bobby Moody motioned to have third reading.  Randy Goings seconded.  Voting for the motion were Harold Moody, Stevie Grice, Robbie Coward, TF Finklea, Randy Goings and Bobby Moody. No action to motion was Archie Scott.  Motion carried.
 
SECOND READING – AN ORDINANCE AUTHORIZING PURSUANT TO TITLE 12, CHAPTER 44 OF THE CODE OF LAWS OF SOUTH CAROLINA 1976, AS AMENDED, THE EXECUTION AND DELIVERY OF A FEE-IN-LIEU OF AD VALOREM TAXES AGREEMENT,

BY AND BETWEEN DILLON COUNTY, SOUTH CAROLINA, AND A COMPANY KNOWN TO THE COUNTY AS PROJECT BEACON X, AS SPONSOR, AND ONE OR MORE SPONSOR

Harold Moody motioned to have second reading.  Bobby Moody seconded and all were in favor.

RESOLUTIONS/PROCLAMATIONS
DOMESTIC VIOLENCE AWARENESS MONTH
Alan Berry read the proclamation.  Robbie Coward motioned to approve proclamation for Domestic Violence Awareness Month.  Archie Scott seconded and all were in favor.

PROJECT BEACON X
Stevie Grice motioned to approve resolution for Project Beacon X. Robbie Coward seconded and all were in favor.
